Lofaro, Adam Lozano and Angelena Lozano to Mortgage Electronic Registration Systems, Inc. as nominee for M & T Mortgage Corporation, its successors and assigns, dated July 31, 2006 and recorded in Book 434 Page 182 of the Land Records of the Town of Bennington, of which mortgage JPMorgan Chase Bank, National Association is the present holder, and in accordance with the Judgment Order and Decree of Foreclosure entered in the action entitled JPMorgan Chase Bank, National Association v Francis C. Lofaro, Adam Lozano, Angelena Lozano and Occupants of 22 and 22 1/2 Robinson Avenue, Bennington, VT, by the Bennington Unit, Civil Division, Vermont Superior Court, Docket No. 393-10-08 Bncv for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 22 Robinson Avenue & 22 1/2, Bennington, Vermont on July 3, 2013 at 10:00 am all and singular the premises described in said mortgage, To wit: Being the same lands and premises conveyed to Harvey P. Welsh and Rosa E. Welsh by Warranty Deed of Alfred N. Boutin, dated November 22, 1988 and recorded November 23, 1988, in Book 0-275, at page 236 of the Bennington, Vermont Land Records and being therein described as follows: “it being a certain part of that parcel of land situated in the town of Bennington and commonly known and called “Clark’s Woods’ and being Lot No. 102 according to a map of building lots owned by Ward L. Lyons, Bennington, Vermont, Office of M.J. Burrington, Jr., C.E. October 1923 and bounded as following: “Bounded on the north by Lot No. 103; formerly owned by Joseph Tetrault; on the east by the Walloomsac River; on the east by the Walloomsac River; on the south by Lot No. 101 and on the west Governor Robinson Street. Said lot has a frontage of fifty feet and the side lines are parallel.” “Being the same lands and premises granted to Alfred N. Boutin and Frances K. Boutin by warranty deed of Joseph F. McGrath and wife dated September 26th, 1986 and recorded in book 0-260 at Page 176 of the Bennington Land Records. Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
