MORTGAGEE’S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY
As ordered by the Court set forth below and in connection with a certain mortgage given by Wayne R. Siebold and Robin Siebold to Mortgage Electronic Registration Systems, Inc. acting soley as nominee For Equity Bank NA, its successors and assigns, dated January 11, 2008 and recorded in Book 150 Page 569 of the Land Records of the Town of Dorset, of which mortgage CitiMortgage, Inc., is now the present holder, and in accordance with the Judgment Order and Decree of Foreclosure entered August 20, 2012 in the action entitled CitiMortgage, Inc. v Wayne R. Siebold and Robin Siebold, by the Bennington Unit, Civil Division, Vermont Superior Court, Docket No. 300-8-11 BNCV for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 2832 Dorset Hill Road, Dorset, Vermont on June 17, 2013 at 1:00 pm all and singular the premises described in said mortgage,
Being all and the same lands and premises conveyed to Anthony W. Foster and Jacquelyn Z. Foster by Warranty Deed of Thomas D. Bush, Jr. and Tara E. Bush, dated September 18, 1998 and recorded in Book 103 at page 431 of the Dorset Land Records.
Being all and the same lands and premises conveyed to Thomas D. Bush, Jr., to Thomas D. Bush, Jr. and Tara E. Bush by Warranty Deed dated September 19, 1985 and recorded in the Dorset Land Records in Book 65 at Page 221 and therein described as follows:
“Being the same lands and premises conveyed to Thomas D. Bush, Jr. a/k/a Thomas Bush, Jr. by Warranty Deed of Claude G. Dern dated June 29, 1984 and recorded June 29, 1984 in the Land Records of the Town of Dorset in Book 62 at page 105 and therein described as follows:
“Being a portion of the lands and premises conveyed to Claude G. Dern by Warranty Deed of Laurin Capen dated march 31, 1980 and recorded April 1, 1980 in the Land Records of the Town of Dorset in Book 54 at Page 261, a portion of the lands and premises conveyed to Claude G. Dern by Quit Claim Deed of Inez Beebe dated January 12, 1982 and recorded January 13, 1982 in the Land Records of the Town of Dorset in Book 57 at page 312, a portion of the lands and premises conveyed to Claude G. Dern by Quit Claim Deed of Howard G. Brophy dated June 29, 1984 and to be recorded in the land Records of the Town of Dorset, a portion of the lands and premises conveyed to Claude G. Dern by Quit Claim Deed of Wales Hawkins, dated June 27, 1984 and to be recorded in the Land Records of the Town of Dorset.
“Said property is more particularly described as Lot 1 on a survey entitled ‘Quarry Hill Subdivision’ prepared by Ericksen, Dern, Lattuga Associates dated June, 1984.
“Lot 1: Beginning at the center line of Quarry Hill Road at the southwest corner of lands conveyed by Capen to Grantor, approximately 2.8 miles from intersection of Quarry Hill Road with Morse Hill Road, thence South ?80° East a distance of 1185 feet more or less, to a corner; thence turning and running North 21° East distance of 402 fee, more ore less, to a corner; thence turning and running North 80° West a distance of 1125 feet, more or less, to the centerline of said Quarry Hill Road; thence turning and running southerly 420 feet, more ore less, along said centerline to the point and place of beginning, containing 10.4 acres, more or less.
“Said lot is conveyed subject to the rights of the public within the limits of the public highway on the western boundary of the property and Grantor reserves the right to grant utility easements within the limits of the public highway.
“Said property is conveyed subject to an easement by Grantors to James A. Hewes for purposes of ingress and egress to Lot 2, Quarry Hill Subdivision, over a strip of land 22 feet in width from Quarry Hill Road across the northwest corner of Lot 1 to Lot 2, commencing 120 feet southerly from the northwest corner of Lot 1. Grantee agrees not to place or store anything within said easement area. Said easement was granted under Easement Deed dated September 18, 1998 as recorded in the Dorset Land Records on September 22, 1198 in Volume 103 at page 429.
Said lands and premises are conveyed SUBJECT TO the Release of Restrictive Covenant dated September 18, 1998 as recorded in the Dorset Land Records in Book 103 at page 427 under which Lots 1, 2 and 3, Dorset Hill Road were released from the restriction to “no structure may be built, placed or maintained on the property closer than 100 feet easterly from the edge of the public highway bordering the property on the west.”
Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description.
Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid in cash, certified check, bank treasurer’s or cashier’s check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer’s or cashier’s check within thirty (30) days after the date of sale.
The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
