By virtue and in execution of the Power of Sale contained in a certain mortgage given by Jason L. Lofaro, Sr. to Mortgage Electronic Registration Systems, Inc. as nominee for CTX Mortgage Company, LLC dated January 3, 2007 and recorded in Volume 130, Page 12, which mortgage was assigned from Mortgage Electronic Registration Systems, Inc. as nominee for CTX Mortgage Company, LLC to Wells Fargo Bank, N.A. by an instrument dated March 10, 2009 and recorded on March 26, 2009 in Volume 135, Page 725 of the Land Records of the Town of Shaftsbury, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purposes of foreclosing the same will be sold at Public Auction at 10:00 A.M. on July 31, 2013, at 42 Colvin Avenue, Shaftsbury, Vermont all and singular the premises described in said mortgage:
Being all and the same lands and premises conveyed to Jason L. LoFaro, Sr. by Warranty Deed of William B. Colvin and Edwin Andrew Colvin, Co-Trustees of the December 26, 1996 Barbara D. Colvin Trust dated January 3, 2007 and recorded January 8, 2007 in Volume 130, Page 10 of the Town of Shaftsbury Land Records.
Terms of Sale: $10,000.00 to be paid in cash or cashier’s check by purchaser at the time of sale, with the balance due at closing. The sale is subject to taxes due and owing to the Town of Shaftsbury.
The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
