By virtue and in execution of the Power of Sale contained in a certain mortgage given by Michael M. Hazlett to IndyMac Bank, F.S.B. dated March 21, 2006 and recorded in Volume 73, Page 155, which mortgage was assigned from OneWest Bank, F.S.B., as successor in interest to IndyMac Federal Bank, F.S.B. f/k/a IndyMac Bank, F.S.B. to OneWest Bank, FSB by an instrument dated May 11, 2009 and recorded on May 20, 2009 in Volume 81, Page 97 of the Land Records of the Town of Sunderland, which mortgage was re-assigned from Federal Deposit Insurance Corporation as Receiver for IndyMac Federal Bank, F.S.B., as successor to IndyMac Bank, F.S.B. to OneWest Bank, FSB by an instrument dated February 17, 2010 and recorded on March 15, 2010 in Volume 82, Page 316 of the Land Records of the Town of Sunderland, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purposes of foreclosing the same will be sold at Public Auction at 9:00 A.M. on July 31, 2013, at 249 Beaver Meadow Road, Sunderland, Vermont all and singular the premises described in said mortgage:
Being all and the same lands and premises conveyed to Michael M. Hazlett by virtue of a Warranty Deed from Edward W. Schmaler dated March 21, 2006 and recorded March 24, 2006 in Volume 73, Page 152 of the Sunderland Land Records. EXCEPTING & RESERVING there from is a portion of the above described property conveyed to Dianne Beattie by virtue of a Warranty Deed from Michael M. Hazlett dated June 13, 2008 and recorded on June 16, 2008 in Volume 79 at Page 213 of the Town of Sunderland Land Records.
Terms of Sale: $10,000.00 to be paid in cash or cashier’s check by purchaser at the time of sale, with the balance due at closing. The sale is subject to taxes due and owing to the Town of Sunderland.
The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
