NOTICE OF SALE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Carri Radcliffe and Bradley Krause to Mortgage Electronic Registration Systems, Inc. as nominee for New Century Mortgage Corporation dated November 28, 2006 and recorded in Book 439 at Page 48 of the City/Town of Bennington Land Records, of which mortgage the undersigned is the present holder by Assignment of Mortgage recorded on August 25, 2009 in Book 465 at Page 168, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 9:30 a.m. on July 23, 2013 at 240-242 Bradford Street, Bennington, VT 05201 all and singular the premises described in said mortgage,
Being all and the same lands and premises conveyed to Carri Radcliffe and Bradley Krause, by Warranty Deed of Madelyn M. Fonteneau dated September 29, 2004, and recorded October 1, 2004, in Book 414, at Page 36 of the Bennington, Vermont Land Records and being therein described as follows:
Being the same lands and premises conveyed to Madelyn M. Fonteneau by Warranty Deed of John P. Lingner and Laurie Lingner dated February 14, 2002 and recorded February 15, 2002 in Book 380 at Page 37 of the Bennington, Vermont Land Records, described as follows, viz:
“Being all and the same lands and premises conveyed to John P. Lingner by Warranty Deed of Elizabeth A. Wilcox and Ruth Vincent dated September 16, 1994, recorded September 20, 1994 in Book 0-315, Page 157 of the Bennington Land Records;
“Being also the same lands and premises conveyed to Elizabeth A. Wilcox and Ruth Vincent by Warranty Deed of Elizabeth A. Wilcox dated January 26, 1933 and recorded January 27, 1933 in Book 0-303, Page 35 of the Bennington Land Records, and therein described as follows:
BEING THOSE LANDS AND PREMISES conveyed to this Grantor by Warranty Deed of Harold W. Dockum, Jr. and Arlene J. Dockum as dated May 16, 1969 and recorded May 23, 1969 in Book 0-186, Page 162 of the Town of Bennington Land Records, and more particularly described as follows:
It being all and the same lands and premises which were conveyed unto the said Harold W. Dockum, Jr. and wife by warranty deed of Louis Sothoron Hill and wife dated July 3, 1947 in Book 0-101 at Page 65 of the Bennington land records and therein described as follows:
“Beginning at a point in the west line of Bradford Street, so-called, in the Village of Bennington, Vermont, which point marks the northeast corner of lands formerly occupied by Hewitt and the southeast corner of the within described parcel; thence northerly along the west line of Bradford Street forty one and twenty-five hundredths (41.25) feet to a stake in the ground; thence westerly and on a line parallel with the north line of lands of said Hewitt a distance of one hundred thirty-nine and two hundredths (139.02) feet to the east line of lands now or formerly of Roscoe Davis and wife; thence southerly along the east line of said Davis a distance of forty-one and twenty-five hundredths (41.25) feet to the north line of said Hewitt; thence easterly along the north line of said Hewitt a distance of one hundred thirty-nine and seventy-five hundredths (139.75) feet to the place of beginning.
“Meaning and intending hereby to convey the easterly part of a parcel of land described in a deed of Charles E. and Mary J. Snow, husband and wife, to Corwin Chester Elwell, which deed is dated September 3, 1919 and recorded in Book 0-12 at page 118 of the land records of the town of Bennington.”
Plaintiff may adjourn this Public Auction one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment. Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. Proof of financing for the balance of the purchase to be provided at the time of sale. The sale is subject to taxes due and owing to the Town of Bennington.
The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
