NOTICE OF SALE
By virtue and in execution of the Power of Sale contained in a certain mortgage given by Michael Goldner to Mortgage Electronic Registration Systems, Inc., as nominee for Royal Bank America Home Loans, a Financial Institution dated July 7, 2006 and recorded in Book 143 at Page 573 of the Dorset Land Records, of which mortgage the undersigned is the present holder by Assignment of Mortgage recorded on September 30, 2009 in Book 157 at Page 662, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 9:00 a.m. on July 12, 2013 at 1270 Dorset West Road, Dorset, VT 05251 all and singular the premises described in said mortgage,
Being the same lands and premises conveyed to Donald A. Conner by Administrator’s Deed of Charles Bulterman, Administrator of the Estate of Hope Bulterman dated April 3, 2000 and recorded May 21, 2000 in Volume 110, Page 419-422 of the Dorset Town Land Records.
Beginning at an iron rod found in the easterly line of Dorset West Road (TH-1), which rod marks the westernmost corner of lands of Sally S. Westphalen and the southernmost corner of the herein conveyed premises; thence running along the said Westphalen lands of the following three courses and distances: North 40 degrees 25′ 36″ East 197.19 feet to a 1/2 inch iron pipe found up 22 inches in a stone wall, thence North 22 degrees 31′ 02″ East 240.24 feet to an unmarked point in the Dorset Marsh, and thence North 27 degrees 00′ 00″ West 370.93 feet to an unmarked point in the Dorset March, so-called; thence running through lands of the Grantor and along the southerly line of Lot A depicted on the plat hereinafter referred to, South 51 degrees 15′ 00″ West (passing through an iron rod at 171.55 feet) a total distance of 471.55 feet to an iron rod set in the easterly line of Dorset West Road, which rod lies North 51 degrees 32′ 22″ East 50.53 feet from a marble marker found on the westerly side of Dorset West Road; thence running South 37 degrees 49′ 28″ East 515.75 feet along the easterly line of Dorset West Road to the point of beginning; containing 4.51 acres of land, be the same more or less.
Being Lot B as depicted on a survey plat entitled “Proposed Subdivision for the Property of Hope C. Bulterman, Est. Town of Dorset…date of plat November 24, 1999 prepared by Charles M. Stewart, LS#454 and having a file number of B 306. All notes on said plat are incorporated in the foregoing description by reference. Bearings are referenced to TRUE NORTH.
The common boundary line with lands of Westphalen referred to in foregoing description is subject to a BOUNDARY LINE AGREEMENT AND QUIT CLAIM DEED between Sally S. Westphalen and Charles Bulterman, as Administrator of the Estate of Hope C. Bulterman, dated February 1, 2000 and recorded February 2, 2000 in the Dorset Land Records, Book and Page not yet assigned.
Being a portion of the lands and premises which were conveyed to Hope C. Bulterman by Warranty Deed of Marie Martin dated February 28, 1987 and recorded at Book 70, Page 82 of the Dorset Land Records.
By the acceptance of this deed, the Grantees hereby acknowledge that the existing spring situated on the herein conveyed Lot B has been abandoned, and covenant for themselves, their heirs and assigns that the said spring shall not hereinafter be used as a source of domestic water supply for this lot.
The Grantor hereby covenants for himself, his successors and assigns, that no buildings shall be placed or erected on the Grantor’s retained Lot A within 100 feet of the northerly line of the herein conveyed Lot B, as shown on the survey plat above referred to; however, septic leach fields are permitted within this restricted zone.
This parcel is the subject of Vermont Homestead Exemption #HE-8-0412-1 dated December 22, 1999, recorded December 27, 1999 at Book 109, Page 125 of the Dorset Land Records.
Plaintiff may adjourn this Public Auction one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment. Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. Proof of financing for the balance of the purchase to be provided at the time of sale. The sale is subject to taxes due and owing to the Town of Dorset.
The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
